This article clarifies the legal position regarding employment rights following the transfer from NHS health authorities to NHS trusts. It explores the impact of the NHS and Community Care Act 1990 and examines the mechanism for transfer and the effect on contracts of employment. It also describes nurses' rights if substantial changes are made to their detriment and the question of redundancy.
